(the top rating awarded) by Martindale-Hubbell. The AV rating is based
on a peer review system derived from information provided by lawyers and
members of the judiciary. It is the rating given to those lawyers recognized
by the legal community as having outstanding legal skills and those that
subscribe to the highest level of ethical standards. Not every lawyer
is AV rated.
Mr. Breedlove is also a lifetime
member of the Multi-Million Dollar Advocate’s forum. Less than 1%
if the lawyers in America are members of this prestigious group. Mr. Breedlove
was the first lawyer in the Capitol-Saratoga- Lake George region to attain
membership in this group of the top trial lawyers in America.
Brian H. Breedlove graduated with
a B.S. degree in Criminal Science from Russell Sage College in 1974 and
a Juris Doctor from Western New England College of Law in 1977. He was
admitted to the Nevada Bar in 1978 and the New York State Bar in 1984.
He has also been admitted before the United States District Courts in
the Northern, Southern and Eastern Districts of New York as well as the
U.S. Courts of Appeals in both the Second and Ninth Circuits. He has been
involved in Civil and Criminal Trial Practice in both State and Federal
Courts. He has been Trial Counsel in Hundreds of cases involving Serious
Personal Injuries and death. He has also tried Police Misconduct, Civil
Rights, Employment Discrimination (Age, Race and Gender), Sexual Harassment,
Medical Malpractice and Negligence cases. Mr. Breedlove’s practice
emphasizes catastrophic personal injury cases and Business litigation.
Mr. Breedlove is a Member of the
Executive Board of the Saratoga County Bar Association, New York State
Bar Associations (Insurance, Trial Lawyer’s, and Criminal Justice
Sections), American Association of Justice (American Trial Lawyer’s
Association), and the Capital District Trial Lawyer’s Association.
Mr. Breedlove has been a regular
instructor at Continuing Legal Education (CLE) courses offered by certified
CLE providers such as the Capital District Trial Lawyer’s Association,
the New York State Bar Association and the Saratoga and Albany County
Bar Associations on diverse subject matter including “Cross Examination
of Expert Witnesses”, “Accident Reconstruction”, “Seat
Belt defense”, “Real Evidence” and “Ethics and
Evidence”. He has also lectured on issues in Employment Discrimination
and Sexual Harassment. These CLE courses are attended by lawyers seeking
to further their own education and develop skills in specific areas of
law. They are taught by lawyers with a long track record of success and
expertise which is widely recognized in the legal community.
On October 5, 2007 in Cote v. UPS,
Mr. Breedlove recovered a verdict of $11,160,308.80 for a motorcyclist
injured in a crash with a UPS truck. Both UPS and the local police blamed
Mr. Cote, the motorcyclist for the accident. UPS spared no expense in
presenting expert witnesses including an engineer accident reconstructionist
in support of their claims. At the conclusion of a two and a half week
trial the Jury found UPS 100% responsible for the accident and awarded
the highest verdict in Warren County history. This verdict is believed
to be the highest motorcycle accident award in the history of upstate
New York.
